TERMS OF CUSTOM PAINTING SERVICE

The Custom Painting is the form of service provided by the Artist to the Client per the Commission Agreement:

 

COMMISSION AGREEMENT

​

The discussion/agreement is documented via email, in which the artist and the client, agreed to the subject and type of commission/artwork to be produced: The commission price, the point in time in which the artist is expected to commence the start of work, and the commission deadline, early termination circumstances, rush fees, transfer of copyright, and, or whether or not, the commission displaying in the artists' portfolio. 

By the point in time which the Client and Artist have approved to start work on the Commission, a 50% up-front fee payment must be made before the work started. ( bank account transfer, PayPal). 

The commission will be sent to the purchaser after the agreed payment in full amount has been received.

COPYRIGHT POLICY

​By commissioning the Artist, the Client is purchasing the Artist’s labor only. The Artist retains copyrights to the Commission, which includes: distribution, reproduction, and use of the Commission for the Artist's public promotion, as long as there is no Transfer of Copyright to the client discussed before the work started. The artist also retains full copyright for any preliminary designs and incidental works made in the creation of the Commission, unless otherwise agreed upon.

​​The Artist will not reproduce Copyrighted images without expressed written permission of its owner.

 

​RESTRICTIONS

​

  • The Client may not distribute, reproduce, or otherwise profit from the Commission,  beyond the resale of the original commission/artwork.

  • The client may not edit, alter, or trace the Commission/artwork without the Artist’s expressed written permission, or as agreed upon in the Commission Agreement before the Start of Work. 

  • The client cannot display a Commission outside of Personal Space or in Public Space. The Client must obtain written permission from the Artist before displaying the Commission in a Public Space if not already defined in the Commission Agreement. The Client may display the Commission in Profiles as long as the Artist’s BRAND/NAME is prominently displayed along with a link to www.streamofdreams.design or @streamofdreamsdesign for social media accounts.

  • If the commission is defined as confidential, the artist will delay the public display of the image at the request of the client. A Client may not request the Artist not display the artwork unless it is discussed before the work started. 

  • Under any circumstances, the Client may not submit a Commission to any kind of online/offline contest.​​

RESPONSIBILITY

  • The Client is responsible for ensuring that their contact details are true and correct.

​

  • The Client may request a preview of the Commission at any time during the creation process, but may not request changes to the Commission after the start of work or approval of the draft.

​

  • The Artist will inform the Client regularly of progress (including photos) or if changes to completion times have occurred. 

​

  • The Artist will ensure the packaging of the Commission is safe and secure and will provide postage and tracking details to the Client once the Commission has been posted.

REFUND POLICY

  • To minimize "Disliking the commission" or "Change of mind", the artist provides photos of the work in progress throughout the Commission process.

  • Any damages or misplacement caused at the fault of the Client or during the Client's possession will not be refunded.

  • If damages have occurred, the Client must notify the Artist within seven (7) days of receiving the Commission and must provide evidence of said damages.

​

  • The Client has thirty (30) days to send the Commission back to the Artist. The Client must return the Commission in original packaging with all documents. ​

​

  • ​​Once the damaged commission has been received, the full refund will be paid back to the Client at the discretion of the Artist.​​

​​

  • If the Commission is stolen, lost, or perished during transit, the Artist will remake the commission, due to the client's request.
